Official Contest Rules

1. General. These terms and conditions are the official Contest Rules (the "Official Rules"). No purchase necessary. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. There is no cost to register or enter. Void where prohibited or restricted by law. All federal, state, and local laws, rules and regulations apply. Odds of winning depend on the number of eligible entries received.
2. Eligibility. Contest is offered only to legal U.S. residents who are at least eighteen (18) years of age at the time of entry. One winner per household. One winner per family. Prizes are non-transferable by winners. Employees of All Aboard Toys, LLC, DR Contest Admin, LLC, any parent, subsidiary and affiliated companies, and their advertising or promotional agencies (collectively, the "Contest Entities"), and the immediate families or members of the same households of such individuals are not eligible. Proof of age, identity, and eligibility must be furnished to the Sponsor upon request. The Sponsor will not award a prize to anyone not meeting eligibility requirements at the time of entry. The Sponsor reserves the right to disqualify any entrant if these Official Rules are not followed. By entering, you agree to comply with all applicable laws and these Official Rules, and you agree to abide by all decisions of the Sponsor, which shall be final.
3. Entries. All entries must be received by the Sponsor during the Entry Period to be eligible for the random drawing. The Sponsor is not responsible for verifying receipt of entries. Entries become property of the Sponsor and will not be returned. Limit one entry per person. All entry form information must be complete and accurate. Incomplete entries are void. The Sponsor is not responsible for entries that are lost, late, misdirected, stolen, incomplete, incomprehensible, illegible, damaged, undeliverable or delayed. Entries into this Contest generated by a script, macro, robot or other mechanical or automated means are void and will be disqualified. Further, the Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of this Contest or to be acting in violation of these Official Rules or in any disruptive manner. Each potential winner may, in the sole discretion of the Sponsor, be required to complete, execute and return an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release within three (3) days of receipt. If: (a) any Affidavit/Releases are not returned within the stated time; (b) a potential winner does not comply with these Official Rules; or (c) a potential winner is to be found ineligible, then that potential winner will be disqualified and an alternate winner may be selected from among all remaining eligible entries.
4. Award. After the Entry Period ends, the Sponsor will conduct a random drawing of all eligible entries received during the Entry Period. Prize will be delivered via email per information provided by winner. The Sponsor is not responsible for incomplete, incomprehensible, illegible, or out-of-service contact information. If the Sponsor is unable, after making a reasonable effort, to contact a selected winner, that winner will be disqualified and a new winner may be selected from remaining entries. All charges, fees, and costs not specifically included in the applicable prize descriptions are the responsibility of the prize winner if applicable. The Sponsor reserves the right to substitute prizes of equal or greater value, or substitute any prize, should a prize become unavailable or out of date. Each winner will be posted on the All Aboard Toys, LLC Website after each drawing.
5. Release. Winners and entrants agree, except where prohibited by law, to release and discharge, hold harmless and indemnify the Contest Entities and their employees, agents and representatives, officers and directors and their immediate families, successors and assigns, and all others associated with the development and execution of this Contest, from any and all liability, including, without limitation, tax liability, that may be imposed or associated with the Contest or the receipt or use of the prizes, and from and against any and all claims, actions, proceedings, and liability for any damages, expenses, fees, injury or losses (INCLUDING PERSONAL INJURY OR DEATH) sustained in connection with the receipt, ownership, or use of the prize or while traveling to, preparing for, or participating in any Contest-related or prize-related activity. Except where prohibited by law, by entering the Contest or by winning, you grant to the Sponsor the right to publicize your name, photograph, image, likeness, voice, statements, and biographical information for advertising, trade, and promotion purposes without compensation and without opportunity for review. In the event the selected winner of the prize is ineligible or refuses the prize or in the event the prize is forfeited for any other reason, the prize will be forfeited and the Sponsor in its sole discretion may randomly select an alternate winner from remaining eligible entries. Prizes may be considered income, and any and all taxes associated with prizes are the responsibility of the winner. The Contest Entities are not responsible if for any reason winner is unable to use a prize in whole or in part.
6. Internet: By participating, you agree to comply with these Official Rules including all eligibility requirements. Entries not complying with these Official Rules are subject to disqualification. If for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest or downloading any materials in this Contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Entry can only be made via one email address per user name. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
7. Privacy: Information collected from entrants is used only for the purpose of the prize drawing and to notify potential winners, and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless entrant has opted-in to receive additional information and promotional material from Sponsor or a third party. 8. Limitation of Liability: The Contest Entities are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in this Contest; (b) technical failures of any kind, including, but not limited to, the malfunctioning or unavailability of any computer, cable, network, hardware, software, Internet service or website; (c) unauthorized human intervention in any part of the entry process or this Contest; (d) technical or human error which may occur in the administration of this Contest or the processing of entries; or (e) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in this Contest or receipt, redemption or use of any prize.
9. Disputes: Except where prohibited, each entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prizes awarded, other than the administration of this Contest or the determination of winners, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate State of Colorado court located closest to Denver, Colorado; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorney's fees; and (c) under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any an all rights to have damaged multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligation of the entrant and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of Colorado without giving effect to any choice of law or conflict of law rules (whether of the State of Colorado or any other jurisdiction), which would cause the application of the laws of any jurisdictions other than the State of Colorado.
